Street Vendors’ kin awarded compensation of Two lakh rupees by Human Rights Commission

On 20th February 2009, Bihar State Human Rights Commission has asked the kin of dead Naresh Shah a street vendor by profession to be compensated with 2 lakh rupee due to death in jail. The vendors had protested forcible taking away of lychee fruit by the Assistant Sub Inspector (ASI) Lakshman Yadav. The main accused of the case ASI Lakhan Yadav has been ordered to be suspended and institution of departmental enquiry. The Commission had asked examining the role of Jail Doctor and Jail Superintendent; the commission has also expressed displeasure on role of the then Superintendent of Police, Vaishali. The case has been heard by Chairman of the Commission, Justice S.N. Jha. The Chairman of the Commission felt that the accused ASI was protected by the senior officials. The Commission had first asked report from the SP, Vaishali but was not satisfied with the report. Thereafter the commission directed IG A.K. Seth for enquiry.

 

The case relates to forcible taking of lychee fruit in Hajigaon on 28 May, 2008 by ASI Lakhan Yadav from Sunaina Devi. Sunaina Devi demanded Rs. 80 as cost of lychee fruit on which the ASI got agitated. He wanted the lychees for free. The ASI threatened Sunaina Devi and soon other vendors joined protest with Sunaina Devi. The agitated ASI got the Police Station to institute false case against Sunaina Devi, her relatives Naresh Shah and others. Naresh Shah was not in the scene at that time but he was arrested and sent to Jail where he died.
